1. Acceptance of Terms

By accessing or using TradeAPEX™ ("the Platform," "we," "us," or "our"), operated as a sole proprietorship based in New York City, NY, you ("User," "you") agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Platform.

You must be at least 18 years of age and legally permitted to trade financial instruments in your jurisdiction to use this Platform.

2. Not Investment Advice

TradeAPEX™ is NOT a registered investment advisor, broker-dealer, or financial institution. Nothing on this Platform constitutes investment advice, financial advice, trading advice, or any other sort of advice.

All content, signals, analysis, AI-generated recommendations, political intelligence reports, and automated trading actions are provided for informational and educational purposes only. You should consult a qualified financial advisor before making any investment decisions.

The APEX Gambit Engine™, Pre-Crime Engine™, Political Intelligence Terminal, and all other features are analytical tools, not financial advisors. Their outputs do not constitute buy, sell, or hold recommendations.

3. Risk Disclosure

PLEASE READ THIS SECTION CAREFULLY.

You can lose 100% of your capital. Trading cryptocurrencies, stocks, ETFs, and other financial instruments involves substantial risk.
Past performance is not indicative of future results. Any win rates, performance metrics, or historical results displayed on the Platform do not guarantee future performance.
AI systems are not infallible. Our AI-powered signals, including Claude AI analysis, can and will make incorrect predictions. Do not rely solely on our signals.
Automated trading carries additional risks. System failures, connectivity issues, and algorithmic errors can result in unexpected losses.
Cryptocurrency markets are highly volatile. Digital assets can lose significant value in short periods.

4. Performance Claims Disclosure

Any performance metrics displayed on the Platform, including win rates, trade records, and portfolio values, are based on live paper trading, backtesting, or limited real-world testing and are subject to the following limitations:

Results are based on a limited sample size and time period
Paper trading results may not reflect real-world execution costs, slippage, or liquidity constraints
Past results have not been verified by any third party
Market conditions change and historical performance cannot be projected forward

5. API Keys & Security

When you provide exchange API keys (Coinbase, Alpaca, or others), you acknowledge:

Keys are encrypted using AES-256 encryption before storage
You should only provide API keys with trading permissions, never withdrawal permissions
TradeAPEX™ will never initiate withdrawals from your accounts
You are responsible for monitoring your accounts and API key security
You should revoke API keys immediately if you suspect unauthorized access
TradeAPEX™ is not liable for losses resulting from compromised API keys

6. User Responsibilities

You are solely responsible for all trading decisions and their consequences
You must comply with all applicable laws and regulations in your jurisdiction
You must not use the Platform for any illegal purpose
You are responsible for paying all applicable taxes on trading gains
You must keep your account credentials secure

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TRADEAPEX™ AND ITS OPERATORS SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

Trading losses of any amount
Loss of data or profits
System downtime or service interruptions
AI or algorithmic errors
Inaccurate political or market analysis

8. Subscription & Payments

Subscription fees are charged monthly and are non-refundable except as required by law. We reserve the right to change pricing with 30 days notice. Cancellation takes effect at the end of the current billing period.

9. Intellectual Property

The APEX Gambit Engine™, Pre-Crime Engine™, and all associated methodologies, algorithms, and concepts are proprietary to TradeAPEX™. Unauthorized reproduction, reverse engineering, or commercial use is prohibited.

10. Modifications

We reserve the right to modify these Terms at any time. Continued use of the Platform after changes constitutes acceptance of the new Terms.

11. Governing Law

These Terms are governed by the laws of the State of New York, United States. Any disputes shall be resolved in the courts of New York County, NY.
